SCOPE These Terms apply to all purchases made on zabiwa.com. If you buy as a consumer, mandatory consumer protections apply and are not waived by these Terms.

PRODUCTS We sell physical art prints only. Production model: print-on-demand (made after you order). Fulfilment partner: The Print Space (production, packaging, shipping). Paper: Canson Baryta Gloss 320g. Unframed; prints include a white border. Minor variations in color/contrast and paper texture may occur due to screen calibration and printing processes and are not considered defects.

ORDERING & CONTRACT Your order is placed when you complete checkout and payment is accepted. We may refuse/cancel an order for legitimate reasons (e.g., suspected fraud, pricing/stock/technical error). If cancelled before production, you will be refunded the amounts paid.

PRICES Prices are displayed on the website at checkout. Shipping fees (and where applicable taxes/duties) are shown before you confirm payment. For customers outside the EU: import duties/taxes and customs fees may apply and are your responsibility.

PAYMENT Payments are processed by Stripe. We do not store your card details. Stripe may carry out fraud and security checks.

PRODUCTION, SHIPPING, DELIVERY Prints are produced and shipped worldwide by our fulfilment partner, ThePrintSpace. (www.theprintspace.com) Any delivery time shown is an estimate and not a guarantee. Delays may occur due to production timelines, carrier operations, customs processing, or other factors beyond our control. Title to the goods transfers after full payment. For consumers, the risk of loss transfers when you, or a third party designated by you (other than the carrier), take physical possession of the goods, in accordance with applicable consumer law.

CUSTOMER INFORMATION / SHIPPING ADDRESS RESPONSIBILITY You must provide a complete, accurate, and deliverable shipping address at checkout. Orders are produced and shipped exactly as confirmed by you during checkout. If an order cannot be delivered, is lost, or is otherwise affected due to an incorrect, incomplete, or invalid address provided by the customer, the order cannot be replaced, refunded, or resent. Any additional costs resulting from address errors, failed delivery attempts, customs issues, or non-collection remain the responsibility of the customer.

RIGHT OF WITHDRAWAL (EU) — EXCLUSION If you are an EU/EEA consumer, the 14-day right of withdrawal does not apply because the prints are made to order and produced specifically following your purchase (print-on-demand), i.e., “goods made to the consumer’s specifications or clearly personalized”. Accordingly: no returns and no refunds for change of mind.

CANCELLATION BEFORE PRODUCTION You may request cancellation only if production has not started. To cancel, email support@zabiwa.com immediately with your order number. Once production starts, cancellation is no longer possible (made-to-order).

DAMAGED, DEFECTIVE, OR LOST ITEMS — PROCESS (STRICT) We follow The Print Space’s damage and delay handling rules for print-on-demand fulfilment. If your item arrives damaged or materially defective, please contact support@zabiwa.com as soon as possible and ideally within 48 hours of delivery, providing:
- your order number,
- clear photos of the damage or defect,
- photos of the packaging and shipping label. This timeframe allows fast claims handling with our production and shipping partners. It does not exclude or limit any mandatory statutory rights you may have under applicable law. The primary remedy is replacement. Refunds are exceptional and issued only where replacement is not reasonable, in accordance with applicable law.
- REFUNDS & RETURNS — SUMMARY
All prints are made to order (print-on-demand).
No returns and no refunds are offered for change of mind. Cancellations are only possible before production starts. Once production has started, orders cannot be cancelled or refunded. If an item arrives damaged or materially defective, the primary remedy is replacement. Refunds may be issued only where replacement is not reasonable and always in accordance with applicable law.

DELIVERY DELAYS / NON-DELIVERY Normal postal delays and customs delays are not grounds for refunds. If we fail to deliver within the legally required period (or within the timeframe expressly agreed with you), you may have statutory rights to set an additional deadline and then cancel if delivery still does not occur. Where cancellation is legally due, we will refund in accordance with applicable law.

INTELLECTUAL PROPERTY All artworks, designs, and website content are protected by intellectual property laws. Purchase grants you ownership of the physical print only. No rights are transferred to reproduce, distribute, or commercially exploit the artwork.

LIMITATION OF LIABILITY We are not liable for indirect damages (loss of profit, loss of opportunity, etc.). Our total liability for any claim is limited to the amount you paid for the affected order, except where liability cannot be limited under applicable law.

FORCE MAJEURE We are not responsible for delays or failures caused by events beyond reasonable control (e.g., carrier disruptions, customs holds, strikes, natural disasters, outages).

DISPUTES, MEDIATION, AND GOVERNING LAW Governing law: France. Mandatory consumer protections remain applicable. Before court action, consumers may use the free mediation service: CNPM – Médiation de la Consommation (https://www.cnpm-mediation-consommation.eu)

CHANGES TO THESE TERMS We may update these Terms. The version in force is the one published on the website at the time of your order.
